National Law Journal: Three Supreme Court Obstruction Rulings Guided Mueller's Team



A MESSAGE FROM THE EDITOR

We have a full lineup of news from Thursday's release of the redacted Mueller report. In our top story, Marcia Coyle recaps the U.S. Supreme Court cases that were key for Special Counsel Robert Mueller III's team in considering whether President Donald Trump obstructed justice in the Russia investigation. As Coyle reports, Mueller's team analyzed U.S. Supreme Court rulings that are skeptical of the broad wording of obstruction laws and federal prosecutors' use of them. Ultimately, Mueller's team declined to reach a conclusion on obstruction after reviewing those decisions and the evidence. Next, the special counsel's team found evidence suggesting President Donald Trump’s public comments during Paul Manafort's prosecution were aimed at encouraging his ex-campaign chairman not to cooperate with the government—and potentially to influence the jury that eventually found Manafort guilty of financial fraud.
